High Court Reopens DGVCL Case for Recovery from AM/NS India

Hindustan Times has reported that the Gujarat High Court has set aside an order by a commercial court in Surat and ordered re-hearing in a matter where a Gujarat state power utility company Dakshin Gujarat Vij Company Limited has claimed dues to the tune of INR 5,882 crore from AM/NS India, formerly known as Essar Steel. Gujarat High Court Chief Justice Sonia Gokani and Justice Hemant N Prachchhak in an order dated 24 February said “The judgment of 28 September 2021 passed by the second additional senior civil judge, Surat is hereby quashed and set aside and the matter is remitted back to the concerned trial Court for re-hearing on merits. The trial court is directed to hear the suit on merits and in accordance with law and the same shall decide and dispose of as expeditiously as possible.”

Dakshin Gujarat Vij Company Limited in 2018 approached National Company Law Tribunal in Ahmedabad, opposing a resolution plan submitted by the resolution professional. The claim of the applicant was incorrectly determined by the interim resolution professional at INR 1. In its plea, DGVCL said its claim of INR 5,882 crore will stand extinguished if the tribunal approves the plan. It said AM/NS India’s Essar Steel bid does not consider contingent liabilities to debtors. Of the claims of INR 5,882 crore, DGVCL said INR 1,136 crore were towards cross-subsidy surcharge, INR 666 crore towards additional surcharge and INR 4,047.01 crore were for breach of minutes of meeting dated February 2010.

The Supreme Court in its judgment dated November 2019 approved the resolution plan submitted by ArcelorMittal in respect of the corporate insolvency resolution process of Essar Steel India Ltd, after considering the order of the National Company Law Tribunal, Ahmedabad bench and the order of the National Company Law Appellate Tribunal. In November 2020, ArcelorMittal acquired the debt-ridden Essar Steel, which has a steel manufacturing facility at Hazira in Gujarat, after the Supreme Court approved the resolution plan it had submitted to the bankruptcy court.

ArcelorMittal Brasil Orders Danieli’s Water-Treatment Plant

ArcelorMittal placed trust in Danieli innovative solutions, selecting new water treatment technologies to be implemented at the Barra Mansa site in Brazil. It will complete the brownfield installation of new 400,000 tonnes per year medium section mill being supplied by Danieli. The new water treatment plant, consisting of patented DanFilters and exclusive Zero Scale Pit -ZSP, will replace the one serving the dismissed rolling mill. The startup of the new rolling mill and water treatment plant is scheduled by Q3 of 2024.

The major amount of scale in the cooling water comes from the firsts and more critical rolling stands. ZSP is located under the rolling mill to collect water containing rolling mill scale mainly generated during the first rolling steps. It continuously removes the scale from the underground flume, raises it to the mill floor where it is collected in standard skips.

The project also includes DanFilters, the fast-filtering patented filters of Danieli. In fact, three new, 3.800-mm-dia DanFilters will replace four 5,000 mm diameter old filters.

In addition to CapEx savings and no extra OpEx costs, ZSP simplifies maintenance operations.

ArcelorMittal Germany Ramps up Production Faster than Plan

The Welt has reported that due to the easing in electricity and gas prices, the steel manufacturer ArcelorMittal Germany is adjusting its production and getting its plant in Hamburg up and running faster than originally planned. Contrary to original announcements, one of the two blast furnaces at the Bremen site was not even shut down. However, the production volumes of the two blast furnaces were significantly reduced.

Last September, ArcelorMittal shut down a direct reduction plant at its plant in Hamburg, citing the extreme price increases in electricity and gas at the time. In view of the easing in prices, the system will be put back into operation in the first half of the year.

Beursblik: ING verhoogt koersdoel ArcelorMittal

Naar 40,00 euro.

(ABM FN-Dow Jones) ING heeft het koersdoel voor ArcelorMittal verhoogd van 39,00 naar 40,00 met handhaving van het koopadvies. Dit bleek woensdag uit een analistenrapport van de bank.

ING heeft de taxaties voor het staalbedrijf na de publicatie van de cijfers over het vierde kwartaal herzien. Het laatste kwartaal van vorig jaar lijkt duidelijk het dieptepunt te zijn geweest, aldus de analisten.

De bank was in het rapport ook zeer te spreken over de blootstelling van ArcelorMittal aan een aantal herstellende staalmarkt, zoals die in Europa. De staalreus denkt dit jaar meer staal te kunnen verschepen dan de markt groeit.

De sterke balans van de onderneming biedt volgens ING daarnaast nog altijd voldoende ruimte om de aandeelhouder een aantrekkelijke beloning te bieden.

Het aandeel ArcelorMittal noteerde woensdag op een groen Damrak 3 procent hoger op 29,30 euro.

Wat ik me afvraag over de aandelen inkopen :

Doordat de familie Mittal sinds enige tijd niet meer deelneemt aan het inkoopprogramma door hun aandelen ook te koop aan de bieden aan de onderneming dan stijgt hun participatie navenant, is er dan geen kans dat ze arcelormittal op termijn van de beurs halen met een kleine premie, voor alle duidelijkheid ik wil dit niet.

Is de familie Mittal dan verplicht minimum de boekwaarde te bieden of is dat niet nodig?

Staalprijzen zetten de stijgende tendens van de afgelopen maanden voort, ter info.

Dit is wel niet altijd het geval, talloze bedrijven kopen massaal eigen aandelen in : ASML/MICROSOFT....... en die zullen niet naar de EXIT gaan, verschil is wel dat familie MITTAL grootaandeelhouder is.

We zullen het wel zien in de toekomst waar het naartoe gaat, de resultaten zullen wel ondertussen weer noordwaarts evolueren en hopelijk kan de stijgende trend dit jaar vastgehouden worden qua staalprijs.

Nog binnenkort nieuws dat CSP is overgenomen om het positieve momentum te behouden.

To obtain certification, the auditors interviewed a wide range of stakeholders and conducted several technical visits. In total, the auditors conducted over 60 interviews to map stakeholders’ perceptions of Aperam South America.

Aperam South America is an integrated producer of Flat Stainless, Electric and Special Steel. It has a total production capacity of 900,000 metric tons of steel per year and employs over 4000 workers and contractors.

Sarralle to Implement Sarcon at ArcelorMittal Olaberria EAF

After several years using the Sarcon (Sarralle Electrode Regulation System) in its Electric Arc Furnace, ArcelorMittal Olaberria in Spain has once again relied on SARRALLE for the implementation of the same regulation system in its Refining Furnace. Based on decades of experience in the design of Electric Arc Furnaces and Refining Furnaces, SARRALLE offers steel producers an electrode control system for the manufacture of high-performance electrical steel furnaces.

SARCON is based on an embedded control platform, which collects information from the PLCs, the hydraulic room and the transformer. This information is processed and displayed in a highly dynamic HMI. The control signal is operated within the PLC part, which simplifies integration into the automation environment. Intelligent signal interface modules ensure very fast and accurate data sampling with integrated, intuitive and easy-to-operate signal preconditioning and display.

Italian Senate Approves Support for Acciaierie d'Italia.

The Italian Senate has approved a decree for urgent measures for strategic national interest plants, according to ANSA. The decree, passed on 5 January, allows for the transfer of EUR 680 million to the new Taranto plant Acciaierie d'Italia as a bridging loan to cover debts and avoid legal action, as well as support for other strategic companies. The provision will now go to the Chamber for final approval and must be converted into law by 6 March.

The decree also establishes a "shield" to prevent interim sanctions from the judiciary that could affect the continuity of activities at enterprises of national strategic interest. However, the "shield" will only be activated once "organizational shortcomings" are addressed. The approval is expected to restore conditions for the development of Italy's metallurgy industry, which has a significant impact on other small industries in the country's north.

Acciaierie d'Italia is a joint venture between state agency Invitalia and ArcelorMittal Italia (formerly Ilva).

Recall that at the beginning of the year, the Italian Ministry of Finance officially authorized the payment of a grant in the amount of €680 million to the Acciaierie d'Italia. The company, in turn, confirmed its forecast for plans to produce at least 4 million tons of steel at the Taranto steel plant in 2023. In 2024, the plant plans to reach a production volume of 5 million tons. In the second half of this year, the steel plant will also begin the reconstruction of blast furnace No. 5, which has been idle for several years, and the construction of an electric arc furnace. Besides, in the second half of the year it is planned to restart furnace No. 2.

Italy will receive €1 billion from the European Commission for decarbonization within the framework of the Just Transition Fund (JTF). The funds are earmarked for climate transition and economic diversification in areas that are degraded and polluted by industrial exploitation. In particular, we are talking about the province of Taranto. With the help of EU resources, the country intends to support the decarbonization of the Acciaierie d'Italia.

Acciaierie d'Italia Seeks Renewal of Environmental Permit

Italy’s leading steelmaker Acciaierie d'Italia has presented the application for renewal of the integrated environmental authorization for the operation of the steel industry in consideration of the expiry of the Integrated Environmental Authorization AIA set for 23 August 2023, reports Corrier di Taranto.

While the discussion relating to the articulated review procedure which provides for a preliminary update of the previous health damage assessment reports, taking into consideration the emission scenarios of the steel industry before and after the implementation of the interventions of the Environmental Plan.

The Ilva Observatory has been dealing with the subject for some time, the last meeting of which was held on 6 December. The information provided during the aforementioned meeting of the Observatory regarding the activities relating to the definition of the post-operam emission scenario determined by the operation of the current plants adapted to the requirements of the Prime Minister's Decree of 2017 assuming the currently authorized production equal to 6 million metric tons of steel per year, in particular by Italian Institute for Environmental Protection & Research ISPRA , showed a significant reduction of about 40% of dust emissions, both conveyed and diffused.

During the same meeting, Agenzia Regionale per la Prevenzione e la Protezione Ambientale Puglia, involved in the proceeding, reiterated that it did not want to carry out the assessments relating to the post-operam scenario currently envisaged upon completion of the interventions of the Environmental Plan referred to in the 2017 Decreto Del Presidente Del Consiglio Dei Ministri DPCM, asserting that it would not be contemplated in the proceeding.

Italy’s Ministry of Health has announced that, in consideration of the requests of the Ministry of the Environment, there has been an intense discussion with the Istituto Superiore di Sanità in order to arrive at a health assessment relating to the current operation of the plant, which should arrive through an official document which in December was given as imminent but of which we still have no trace.

ArcelorMittal XCarb Green Steel for KIRCHHOFF Automotive

ArcelorMittal and KIRCHHOFF Automotive, which develops and produces complex metal and hybrid structures for body-in-white and chassis, have signed a memorandum of understanding which focuses on developing low carbon-emissions steel for cars and trucks. The agreement covers a number of different areas of development and steel solutions, but its principal focus is to strengthen the two companies’ collaboration on sustainability topics.

This includes a project to develop and test the use of ArcelorMittal’s XCarb® recycled and renewably produced Usibor1500®, which is made with recycled steel and 100% renewable electricity, in the high-strength parts that KIRCHHOFF Automotive supplies to leading OEMs in Europe, Asia, and North America.

ArcelorMittal Europe Flat Products began manufacturing XCarb® recycled and renewably produced steel at its Sestao plant in Spain more than a year ago allowing customers to buy steel with a reduced CO2 impact. Taking the example of Usibor®1500 with XCarb® recycled and renewably produced substrate, on a lifecycle basis this product has a 70% lower CO2 footprint compared with the same product made via a conventional blast furnace production process.

KIRCHHOFF Automotive has a presence across Europe, Asia and North America, with 27 plants in 11 countries.

’Miljard subsidie nodig voor schonere productie Tata Steel’

AMSTERDAM (ANP) - Zonder 1 miljard steun van de Nederlandse overheid wordt de overgang van Tata Steel in IJmuiden naar schone staalproductie moeilijk. Dat zei topman Hans van den Berg van Tata Steel Nederland tijdens een debat in De Balie over de toekomst van het staalbedrijf.

Dat debat werd kort onderbroken door klimaatactivisten van Greenpeace die willen dat de „ziekmakende delen” van het voormalige Hoogovens per direct dichtgaan. Na een korte speech gaven ze bloemen aan de aanwezigen. Alleen Van den Berg kreeg een zwarte tulp.

Ondanks de noodzaak van een forse subsidie is Tata Steel niet ’technisch failliet’, bezwoer Van den Berg. „Tata steekt ook heel veel geld in de vergroening. Als we geen geld van de overheid krijgen zullen we op zoek moeten naar een andere bron van geld.” Maar de onderhandelingen lopen nog, benadrukte Van den Berg ook. „Het is een heel complexe transitie.”

Kooksgasfabriek
In een lijsttrekkersdebat voor de Provinciale Staten van Noord-Holland dat volgde ging vooral veel aandacht uit naar de milieuvergunning van Tata en de dreiging dat Kooksgasfabriek 2, waarmee Tata de uitstootregels herhaaldelijk overtreedt, moet sluiten. Dat staat volgens Tata in 2029 gepland. „Maar als hij eerder dicht kan, zal ik dat zeker doen”, aldus Van den Berg. De topman stelt dat kooks, de speciale steenkool waarop staalfabrieken draaien, ook kunnen worden ingevoerd. „Maar dat is veel duurder. We hebben onze eigen kooksfabriek nodig om de overstap naar groen staal te kunnen financieren.”

Van den Berg benadrukte dan ook dat zijn bedrijf tot de sluiting nog miljoenen blijft investeren in de kooksfabriek. „We doen er alles aan om de uitstoot zoveel mogelijk te beperken.”

Vertrouwen
Dat het vertrouwen van burgers in Tata Steel een dieptepunt heeft bereikt, trekt Van den Berg zich aan. „Ik snap de zorgen. Wat ik kan doen is alles in het werk stellen om de emissies zo laag mogelijk te krijgen. Dat is de weg die gekozen is.” Maar misschien is die weg wel te laat ingezet, geeft de topman van de Nederlandse staalfabriek toe. „De maatschappelijke normen zijn razendsnel aan het veranderen, maar we zijn zelf ook te traag geweest. We hadden proactiever kunnen zijn.”
